A licence is required in order to erect a scaffold on or above the public highway. The licence is issued under section 169 of the Highways Act 1980, generally by the highway authority responsible for the particular stretch of highway. It is quite common for the employers of scaffolding companies to adjust the Applications for Payment / Invoices submitted by the scaffolder. The process is often referred to as setting-off.
